Foris DAX MT Limited in St Julian’s, Malta, holds Crypto.com’s MiCA authorisation. The Malta Financial Services Authority (MFSA) authorised it on 27 January 2025. The ESMA register lists six services: custody, exchange of crypto-assets for funds, exchange of crypto-assets for other crypto-assets, execution of orders, reception and transmission of orders, and transfers. It does not list the operation of a trading platform. ESMA lists every other EEA state as a host state.
Crypto.com says it gave up its Maltese VFA licence as a condition of the MiCA authorisation. It began passporting to the EEA on 12 February 2025, and services continued without interruption.
The French AMF registered Crypto.com as a digital asset service provider in September 2022, after clearance from the banking supervisor ACPR. Crypto.com also referred to registrations in Italy and Cyprus at that time.
De Nederlandsche Bank (DNB) fined Foris DAX MT Limited 2.85 million euros on 2 October 2023 and published the fine on 13 March 2024. DNB found that the company had offered crypto services in the Netherlands without registration from 21 May 2020. Crypto.com said it would appeal, and we found no published outcome. DNB registered the company in the summer of 2023, after the period that the fine covered.
National registrations of this kind could only continue until the MiCA transitional period ended, on 1 July 2026 at the latest. Crypto.com’s EU clients were already with the authorised Maltese entity well before that date.
On 21 May 2025 Crypto.com said CySEC had approved its purchase of A.N. Allnew Investments Ltd, a Cyprus investment firm. The MiFID II licence covers securities, derivatives and contracts for difference, which MiCA does not regulate. We could not confirm which crypto derivatives Crypto.com now offers to EEA retail clients under that licence.
