BingX MiCA status in detail

BingX has an application in progress in Austria. It has no current MiCA CASP entry. BingX said on 16 June 2026 that BingX EU had applied to Austria’s FMA for MiCA authorisation and that no authorisation had been granted. No BingX entity appears in the ESMA snapshot dated 6 October 2026.

Practical effect: CASP-specific MiCA protections are not established for this service until an authorisation is granted. Other permissions can apply to a separate entity. Verify the contracting entity.

If you hold funds on BingX

  1. Read BingX’s latest notice for your country. It sets any account restrictions and withdrawal deadlines.
  2. Move assets to a wallet you control or to a MiCA-licensed exchange. Send a small test transfer first and check the network.
  3. Keep statements, transaction IDs and the date of each withdrawal.
  4. If a withdrawal fails, write to support and report the firm to your national regulator. The MiCA warning list shows whether a regulator has already flagged it. Read when an exchange can freeze your funds.

BingX’s MiCA application in Austria

On 16 June 2026 BingX published a notice that BingX EU had applied to Austria’s Financial Market Authority (FMA) for authorisation as a crypto-asset service provider under MiCA. The notice called the application advanced. It also stated that no MiCA authorisation had been granted at that stage. No BingX entity appeared in the ESMA CASP snapshot dated 6 October 2026.

Which BingX entity serves EU users

The BingX customer agreement, last updated on 2 September 2026, names Nieve Cruz PA Corporation as the contracting party. Hong Kong law governs it, and disputes go to arbitration in Hong Kong. A separate company, Bingmex Limited in Mauritius, provides the MT5 and CFD products.

The customer agreement refers to the restricted list in the BingX disclaimer. The Netherlands is the only EU or EEA state on that list. The Belgian FSMA warning list contains an entry from 5 June 2023 headed BingX, but the FSMA marks it as a cloned firm at a different domain, not the BingX exchange.

Can EU residents still use BingX?

A pending application gives no right to provide crypto-asset services in the EU. Until the FMA decides and ESMA lists a BingX entity, BingX holds no MiCA authorisation. Article 59 of MiCA requires that authorisation before a firm serves clients in the EU, and the national transitional periods ended on 1 July 2026 at the latest.

The MT5 and CFD products of Bingmex Limited are derivatives. ESMA guidelines say crypto derivatives fall under MiFID II, not MiCA, so a MiCA authorisation for BingX EU would not on its own cover those products for EU clients.

Common questions

When will BingX get its MiCA licence?

its national regulator in Austria decides the application and has not published a fixed completion date. BingX becomes an authorised CASP only after a granted licence appears in the ESMA register.

Is BingX regulated in the EU right now?

BingX is not currently an authorised CASP. A pending application does not grant CASP authorisation. Do not assume that MiCA's CASP-specific conduct, safeguarding or complaints rules apply to the service. Another entity or product may have separate permissions, which you must check independently.
