Deribit MiCA status in detail

Deribit does not hold a verified MiCA CASP licence. Deribit is a Dubai VARA-licensed derivatives exchange that Coinbase now owns. The Deribit brand is not on the ESMA register.

Practical effect: Deribit has no verified CASP authorisation. Check the contracting entity and any separate permissions before you rely on MiCA conduct, safeguarding or complaint rights.

If you hold funds on Deribit

  1. Read Deribit’s latest notice for your country. It sets any account restrictions and withdrawal deadlines.
  2. Move assets to a wallet you control or to a MiCA-licensed exchange. Send a small test transfer first and check the network.
  3. Keep statements, transaction IDs and the date of each withdrawal.
  4. If a withdrawal fails, write to support and report the firm to your national regulator. The MiCA warning list shows whether a regulator has already flagged it. Read when an exchange can freeze your funds.

Which Deribit entity serves users and where it is licensed

Deribit FZE in Dubai runs the Deribit exchange. Dubai’s Virtual Assets Regulatory Authority (VARA) issued it licence VL/23/12/002 on 1 November 2024 for exchange services, including exchange-traded derivatives, and broker-dealer services. Deribit had announced a conditional VARA licence and its move to Dubai on 2 April 2024. Deribit says it was founded in the Netherlands and launched in June 2016, and its terms name DRB Group B.V. in Amsterdam as the parent of Deribit FZE.

Retail access runs through DRB Panama Inc., which describes itself as an unregulated broker and a member of the exchange. Coinbase completed its purchase of Deribit on 14 August 2025 for about 2.9 billion US dollars. No Deribit entity appeared in the ESMA CASP snapshot dated 6 October 2026.

Does Deribit need a MiCA licence?

Deribit mainly offers options and futures on crypto-assets. ESMA guidelines published on 17 December 2024 say MiCA does not cover derivatives with crypto-assets as the underlying asset. Such contracts fall under MiFID II, and ESMA says perpetual futures should be treated as derivative contracts. A MiCA authorisation would therefore not, on its own, permit Deribit to offer its main products to EU clients.

Can EU residents use Deribit?

Deribit’s restricted jurisdictions page, updated on 6 October 2026, lists no EEA state. Its registration guide, updated on 12 October 2026, says some users are sent to Coinbase onboarding, depending on their country of residence or incorporation. No help centre article we reviewed mentions MiCA. Coinbase’s own EU crypto services run through Coinbase Luxembourg S.A., which is a different entity from Deribit.

Can I still use Deribit from the EU?

MiCA does not itself make account holding illegal. National and product rules can still apply. Since 1 July 2026, an in-scope provider generally needs an Article 63 authorisation or an eligible Article 60 notification route. Deribit can apply location restrictions or close user accounts.

Is money on Deribit protected under MiCA?

Deribit has no verified CASP authorisation. Do not assume that MiCA conduct, safeguarding or EU-regulator complaint rights apply to the service. Verify the contracting entity and any separate permissions.
