BitMart MiCA status in detail

BitMart does not hold a verified MiCA CASP licence. BitMart has no entry in the ESMA snapshot dated 6 October 2026. France’s AMF has listed it on its crypto-asset derivatives blacklist since 16 March 2026, and Austria’s FMA warned against GBM Global Inc. (BitMart) on 28 August 2026. Its user agreement still accepts users in EU states other than France and the Netherlands.

Practical effect: BitMart has no verified CASP authorisation. Check the contracting entity and any separate permissions before you rely on MiCA conduct, safeguarding or complaint rights.

If you hold funds on BitMart

  1. Read BitMart’s latest notice for your country. It sets any account restrictions and withdrawal deadlines.
  2. Move assets to a wallet you control or to a MiCA-licensed exchange. Send a small test transfer first and check the network.
  3. Keep statements, transaction IDs and the date of each withdrawal.
  4. If a withdrawal fails, write to support and report the firm to your national regulator. The MiCA warning list shows whether a regulator has already flagged it. Read when an exchange can freeze your funds.

Which BitMart entity serves EU users

The BitMart user agreement names GBM Global Inc., registration number 134925, of Majuro in the Marshall Islands, as the contracting party. Section 1.5 lists the restricted locations. France and the Netherlands are the only EU states on that list.

No BitMart or GBM Global entity appeared in the ESMA CASP snapshot dated 6 October 2026. We found no public BitMart announcement of a MiCA application.

EU regulator warnings against BitMart

The French AMF added www.bitmart.com to its blacklist of unauthorised crypto-asset derivatives sites on 16 March 2026. The entry still appeared in the AMF list dated 28 September 2026.

Austria’s Financial Market Authority (FMA) warned against GBM Global Inc., trading as BitMart, on 28 August 2026. The FMA said the company is not authorised to operate a multilateral trading facility under the Austrian Securities Supervision Act 2018. The warning names the German-language site at bitmart.com/de-DE.

Both warnings concern derivatives and trading venue rules under MiFID II, which sit outside MiCA. ESMA guidelines of 17 December 2024 confirm that crypto derivatives fall under MiFID II. The warnings come on top of the missing MiCA authorisation for spot crypto-asset services.

Can EU residents still use BitMart?

BitMart’s terms still accept users from EU states other than France and the Netherlands. Article 59 of MiCA requires a firm to hold an authorisation before it provides crypto-asset services in the EU, and Article 61 only permits service at the client’s own exclusive initiative. EU users of BitMart have none of the MiCA rules on safekeeping of client assets, complaints handling or conflicts of interest on their side.

Can I still use BitMart from the EU?

MiCA does not itself make account holding illegal. National and product rules can still apply. Since 1 July 2026, an in-scope provider generally needs an Article 63 authorisation or an eligible Article 60 notification route. BitMart can apply location restrictions or close user accounts.

Is money on BitMart protected under MiCA?

BitMart has no verified CASP authorisation. Do not assume that MiCA conduct, safeguarding or EU-regulator complaint rights apply to the service. Verify the contracting entity and any separate permissions.
