Poloniex has no current MiCA CASP authorisation and is restricting or withdrawing services for EEA users. Poloniex has no entry in the ESMA snapshot dated 6 October 2026. Its terms of use, revised on 1 April 2026, exclude users in all EU member states.

If you hold funds on Poloniex

  1. Read Poloniex’s latest notice for your country. It sets any account restrictions and withdrawal deadlines.
  2. Move assets to a wallet you control or to a MiCA-licensed exchange. Send a small test transfer first and check the network.
  3. Keep statements, transaction IDs and the date of each withdrawal.

Does Poloniex serve EU users?

The Poloniex terms of use, last revised on 1 April 2026, list all member states of the European Union among the restricted territories in section 39. The same list covers the United States, the United Kingdom and Singapore. The terms define the operator as the Polo group entity that applies to the user’s country of residence. Panama law governs them, and they name Polo Digital Assets Inc. as the representative for EU data protection purposes.

No Poloniex or Polo entity appeared in the ESMA CASP snapshot dated 6 October 2026. We found no public Poloniex announcement of a MiCA application, and the terms do not mention MiCA. We also found no Poloniex entry on the AMF, FSMA or Polish KNF warning lists.

Poloniex’s regulatory history

On 1 May 2023 the US Treasury’s Office of Foreign Assets Control announced a settlement with Poloniex, LLC. The company agreed to pay 7,591,630 US dollars for 65,942 apparent sanctions violations between January 2014 and November 2019. The case concerned US sanctions and has no direct link to MiCA.

What EU residents with Poloniex accounts should know

Under Article 59 of MiCA, a firm must hold an authorisation before it provides crypto-asset services in the EU. Poloniex holds none, and its own terms exclude EU residents. Article 61 allows a non-EU firm to serve an EU client only when the client starts the contact on their own exclusive initiative, and the exemption does not cover new products that the firm markets to that client. EU residents who still hold a Poloniex account have no MiCA protection for custody or complaints.

Can I still withdraw my funds from Poloniex?

Account and withdrawal availability varies during a wind-down. Follow Poloniex's dated official notices and verify the supported withdrawal route. Plan a move to a venue with a current MiCA register entry because access can change.

Why is Poloniex restricting EEA users?

MiCA's transitional period ended on 1 July 2026. An in-scope provider generally needs an Article 63 authorisation or an eligible Article 60 notification route. Poloniex has no verified current route, so it is restricting or withdrawing services.
